1.- Identity of the Data Controller

The information provided by the USER through any of the forms or contact channels of the WEBSITE, which may contain personal data, will be processed by FUNDACIÓN GESTAMP (hereinafter, the “FUNDACIÓN”), with registered office at C/Alfonso XII, 16, 28014 Madrid – Spain, and tax identification number G-56264591, as the data controller. 

2.- Purpose and legal basis of processing

The FOUNDATION will need to process the USER’S data both to respond to requests for information made by the USER through the WEBSITE’S contact channels, and to provide the services requested or to which the USER decides to subscribe or register through any of the WEBSITE’S forms.

The legal basis that legitimizes the processing by the FOUNDATION of the data collected through the WEBSITE may be the express consent of the USER, the contractual relationship between the FOUNDATION and the USER or the legitimate interest of the FOUNDATION when it is, for example, to offer services and products of the FOUNDATION equal or similar to those contracted or previously requested by the USER.

Any USER who contacts the FOUNDATION through the contact channels of the WEBSITE consents to the processing of the data provided through such contact in accordance with the present Data Protection Policy of the WEBSITE.

Any USER who registers through any form on the WEBSITE must consent to the processing of their data in accordance with the Data Protection Policy provided with said form, by checking the consent box provided for this purpose.

THE FOUNDATION will process the information provided by the USER for different purposes, depending on the way the data is collected:

– To send information requested by the USER.

– To manage, administer, provide, expand, adapt and improve the services requested or to which the USER has decided to subscribe or register.

– To design new services related to the previous ones.

The USER consents to the processing of his/her data for the purposes described above, or, if applicable, for the purposes described in the Data Protection Policy provided together with the subscription form to the WEBSITE services, without prejudice to the right to revoke such consent.

3.- Transfer of Personal Data

The data that the USER has provided to the FOUNDATION will not be communicated to any third party, unless:
  • Disclosure is authorized by law.
  • The processing responds to the free and legitimate acceptance of a legal relationship whose development, compliance and control necessarily involves the communication of data to third parties.
  • The data are requested by the Public Prosecutor’s Office or the Judges or Courts or the Court of Auditors, in the exercise of the functions attributed to them.
The FOUNDATION may transfer the data to the companies of the Gestamp Group when it has a legitimate interest, for corporate or administrative reasons.

4.- Mandatory or optional nature of the information requested

The mandatory data of each form will be identified as such in the form itself. The refusal to provide such information will prevent the service requested by the USER.

5.- Storage of the data

The period of conservation of personal data will vary depending on the service, until the service is satisfactorily concluded or until the USER revokes his/her consent. In any case, the period of conservation of personal data will be restricted to the minimum necessary, so that they will only be kept as long as the purpose for which they have been collected is maintained. When their conservation is no longer necessary, the FOUNDATION will keep blocked those data that may be necessary during the legally established periods in order to attend to any question related to their treatment. After the legal deadlines have elapsed, the personal data will be deleted, adopting the appropriate security measures to ensure their total destruction.

6.- Exercise of rights

The USER may exercise his/her rights of access, rectification, cancellation/deletion, opposition, limitation and portability before GESTAMP by sending an e-mail to the address, or by ordinary mail to the address indicated above, identifying him/herself as a USER of the WEBSITE, providing a photocopy of his/her National Identity Card or equivalent document and specifying his/her request.

Likewise, if you consider your right to personal data protection has been violated, you may file a claim before the competent Data Protection Agency (in the case of Spain, before the Spanish Data Protection Agency (

7.- USER’s obligations regarding data protection 

The USER guarantees that he/she is of legal age and that the information provided is accurate and truthful. The USER undertakes to inform the FOUNDATION of any modification to the information provided by sending an e-mail to the address, identifying himself/herself as USER of the WEBSITE and specifying the information to be modified.

Likewise, the USER undertakes to keep the passwords and identification codes secret and to inform the FOUNDATION as soon as possible in the event of loss, theft, or unauthorized access. Until such notification is made, the FOUNDATION shall be exempt from any liability that may arise from the improper use of such passwords and identification codes by unauthorized third parties.

In the event that the USER provides personal data of third parties for any purpose, the USER guarantees to have previously informed the affected parties and to have obtained their consent for the communication of their data to the FOUNDATION.

8.- Security measures

The FOUNDATION has adopted the necessary technical and organizational measures to guarantee the security of personal data and prevent its alteration, loss, unauthorized processing, or access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed.
